01 Data Collection and Use

1.1 Data Provided by Clients

You agree that all information, files, and content submitted through our forms, provided via email, or shared with us by other means is accurate, lawful, and provided with your consent. We collect this data to deliver the services outlined in our agreements.

1.2 Ownership and Responsibility

You confirm that you own or have the right to use all content (e.g., text, images, videos, and other files) submitted to LuceDev LLC. You are solely responsible for ensuring that no content provided violates copyright, trademark, or other intellectual property laws. LuceDev LLC is not liable for any disputes arising from content ownership or unauthorized use.

1.3 Data Protection

LuceDev LLC takes reasonable measures to secure your data. However, we cannot guarantee absolute security, and you agree to hold us harmless for any data breaches caused by factors beyond our control.

02 Services Provided

2.1 Scope of Work

The services provided by LuceDev LLC, including but not limited to website development, hosting, management, professional email setup, and other related services, will be delivered as agreed upon between the client and LuceDev LLC. Any additional requests outside the original scope of work may be subject to additional fees.

2.2 Timeline and Delivery

LuceDev LLC will make every effort to meet agreed-upon deadlines. Delays caused by incomplete or inaccurate client-provided information, late content submissions, or unforeseen technical issues may extend delivery timelines.

2.3 Third-Party Integration and Tools

Certain services may require the use of third-party tools or platforms (e.g., hosting providers, email services, or plugins). While we facilitate these integrations, you agree to adhere to their terms and conditions, which are independent of LuceDev LLC.

03 Payments and Fees

3.1 Payments

All payments must be made as per the terms outlined in your invoice or contract. Late payments may result in service delays, suspension, or additional fees.

3.2 Refunds

Refunds are only available for services not yet rendered. Once work has begun or deliverables have been provided, refunds will not be issued.

3.3 Recurring Fees

Certain services, such as website hosting or email management, may require recurring fees. Failure to pay recurring fees on time may result in suspension or termination of the associated service.

04 Intellectual Property

4.1 Ownership of Final Deliverables

Upon full payment, you will own the final deliverables provided by LuceDev LLC. However, LuceDev LLC retains the right to showcase non-sensitive aspects of the work (e.g., website screenshots) in its portfolio or marketing materials unless otherwise agreed upon.

4.2 Third-Party Tools and Resources

LuceDev LLC may use third-party plugins, themes, or resources in the development of your website or other deliverables. You agree to adhere to the licensing terms of these third-party tools, which are independent of LuceDev LLC.

05 Limitation of Liability

5.1 Disclaimer

LuceDev LLC provides its services "as is" and does not guarantee specific results, including search engine rankings, traffic increases, or financial gains. You agree to hold LuceDev LLC harmless for any losses or damages arising from your use of our services.

5.2 Maximum Liability

LuceDev LLC's total liability under this agreement shall not exceed the total amount paid for services rendered.

06 Privacy and Confidentiality

6.1 Confidentiality Agreement

LuceDev LLC agrees to keep all client-provided information confidential and will not share or disclose it without your consent, except as required by law.

6.2 Privacy Policy

Your data will be handled in accordance with our Privacy Policy.

07 Termination of Services

7.1 Termination by Client

You may terminate services by providing written notice at least two (2) months in advance. Upon notification of cancellation, LuceDev LLC will require payment for two (2) months of hosting fees. No additional cancellation fees will apply. Any work completed up to the termination date will be billed accordingly.

7.2 Termination by LuceDev LLC

LuceDev LLC reserves the right to terminate services for non-payment, breach of terms, or other violations of this agreement.

08 Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Florida. Any disputes arising under this agreement shall be resolved in the courts of Port Saint Lucie, Florida.

09 Changes to These Terms

LuceDev LLC reserves the right to update these Terms of Service at any time. You will be notified of significant changes, and your continued use of our services constitutes acceptance of the updated terms.

10 General Provisions

10.1 Entire Agreement

These Terms of Service constitute the entire agreement between you and LuceDev LLC concerning the services provided and supersede any prior agreements, whether written or oral.

10.2 Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

10.3 Force Majeure

LuceDev LLC shall not be held liable for any delay or failure to perform resulting from causes beyond its reasonable control, including acts of God, natural disasters, cyberattacks, labor strikes, or government actions.
